piCue Terms of Use

1. Parties, scope and formation of the agreement

These Terms of Use govern the conditions applicable to the use of the piCue mobile application, the picue.app website and all digital services connected with them, operated by Piklabs Yazılım ve Teknoloji Hizmetleri Limited Şirketi.

Piklabs may be referred to in this text as “Piklabs”, “piCue”, “the company”, “we” or “us”. The user is the person who uses the piCue mobile application, the picue.app website or any feature of the Service.

The user should review these Terms of Use when creating an account or before using the Service. When the user ticks the “I accept” option, creates an account or continues to use the Service, the user shall be deemed to have accepted these terms and a usage agreement shall be formed between the user and Piklabs.

If the user does not accept these terms, the user must not use the Service, must not create an account and must close any existing account.

These Terms of Use cover:

• the piCue mobile application,
• the picue.app website,
• user accounts,
• the İzleme DNA feature,
• the Picsona feature,
• the film and series recommendation systems,
• lists, favourites and collections,
• the thread, comment and vote features,
• the follow and follower features,
• CueMates matches,
• the game and scoring features,
• the piCue Plus subscription,
• user support and moderation services

all of the above.

2. Relationship with other texts

These Terms of Use shall be read together with the following texts:

• the Piklabs Privacy Notice on the Processing of Personal Data under the KVKK,
• the piCue Privacy Policy,
• the piCue Plus Subscription Terms,
• the terms of use and payment terms of the application stores.

These Terms of Use do not replace the KVKK Privacy Notice. The purposes for which personal data may be processed, the legal grounds for such processing and the parties to whom personal data may be transferred are explained in Piklabs's KVKK Privacy Notice.

In the event of any discrepancy between these Terms of Use and the KVKK Privacy Notice regarding the processing of personal data, the KVKK Privacy Notice and the applicable personal data protection legislation shall apply in respect of personal data processing activities.

With regard to subscription, payment, automatic renewal, withdrawal, cancellation and refunds, the pre-contractual information provided on the purchase screen, the subscription terms, the rules of the application store and the mandatory provisions of consumer legislation shall be taken into account together.

3. Definition and scope of the Service

piCue is a digital service that brings together film and series discovery, user preferences and community interactions.

Within the scope of the Service;

• film and series recommendations may be provided based on user preferences,
• user preferences may be analysed through the İzleme DNA test and card selections,
• personalised results may be generated through the Picsona feature,
• film and series lists, favourites and collections may be created,
• users may share threads, comments and reviews,
• the follow, follower and CueMates features may be used,
• games, scoring and community interactions may take place,
• certain paid features may be offered under the Plus subscription.

piCue is not a streaming platform. piCue does not host, broadcast, rent out or directly play film or series content. The film and series credit information, posters, images or links included in the application may originate from third-party content and service providers.

Where access to a film or series takes place through the website or application of the third-party platform providing the relevant content, that platform's own terms of use, subscription terms, age restrictions, content warnings and privacy policies shall apply.

The recommendations, ratings, content information and classifications on piCue may not be current, complete or free of error. Before deciding to watch an item of content, the user should check the current information and warnings on the relevant streaming platform.

4. Eligibility and age limit

You must be at least 16 years old to use piCue. By creating an account, the user represents that this age requirement is met.

The age limit shall be applied together with the technical operation of the application, the age classifications of the application stores and the mandatory legislation of the country in which the Service is offered. If a higher age limit is prescribed in a given country, the mandatory age limit in that country shall be taken into account.

The user may not open an account on behalf of another person, impersonate another person or provide false information in order to circumvent the age requirement.

If Piklabs determines that the age requirement is not met or that the account information is untrue, Piklabs may restrict, suspend or close the account.

If you believe that a person under the age of 16 holds an account, you may report this to hey@picue.app. Piklabs shall assess the report and, where necessary, restrict the account.

5. Account creation and account security

In order to use certain features of the Service, you need to create an account. When creating an account, you must provide accurate, up-to-date and complete information.

You must comply with the following obligations:

• keeping your account information accurate and up to date,
• not using another person's identity or contact details when opening an account,
• not impersonating another person through your username or profile information,
• keeping your account password and access credentials confidential,
• monitoring the transactions carried out through your account,
• notifying Piklabs immediately if you believe your account has been used without authorisation,
• not creating more than one account per person,
• not opening a new account in order to circumvent a sanction applied to a permanently closed account.

You may be required to complete the verification steps requested by Piklabs in order to ensure account security. Without prejudice to mandatory provisions of law, damages arising from account use caused by the user's own negligence or by the user sharing security credentials with third parties may be borne by the user.

If you believe your account has been used without authorisation, you must send a notification to support@picue.app. You may be asked to provide the information necessary to secure the account.

6. Core rules that users must comply with

When using the Service;

• the law,
• the rules of good faith,
• the rights of third parties,
• personal rights,
• the privacy of private life,
• intellectual and industrial property rights,
• the safety of children and other users,
• these Terms of Use

you must act in accordance with all of the above.

You may not use the Service in order to harm others, carry out unlawful activities, collect personal data, spread misleading information, take over accounts or weaken the security of the platform.

7. Community rules and prohibited conduct

Users may share content in threads, comments, lists, collections, profiles, images or other community areas. However, the following content and conduct are prohibited:

• harassment, threats, insults, humiliation and bullying,
• persistent stalking, targeting or intimidation,
• hate speech and discrimination on the basis of race, ethnic origin, religion, belief, gender, sexual orientation, disability or any other characteristic,
• sexual abuse, child sexual abuse or the use of children in sexual content,
• content involving extreme violence or intended to cause serious distress to others,
• incitement to crime, violence, self-harm or unlawful activity,
• impersonating another person,
• deceiving others with misleading, false or manipulative information,
• spam, chain posts, unsolicited advertising or unauthorised commercial promotion,
• sharing content that infringes intellectual or industrial property rights,
• sharing another person's personal data, private information or private correspondence without permission,
• publishing account passwords, identity documents or financial information,
• extracting content by means of bots, scrapers, automated programs or similar tools,
• creating accounts by automated means or creating large numbers of accounts,
• artificially inflating votes, likes, followers, matches or game scores,
• endangering the security, performance, integrity or accessibility of the Service,
• researching, exploiting or disseminating vulnerabilities in the application without authorisation,
• encouraging another person to breach these rules or assisting in such a breach.

Where a user, of their own volition, shares personal data belonging to third parties in a publicly accessible area, Piklabs may remove such content, limit its visibility or take action in respect of the account.

8. Rights in user content and the licence granted to Piklabs

Unless otherwise provided by law, ownership of the comments, lists, collections, profile descriptions, images and other user content created by the user belongs to the user or to the relevant rights holder.

By uploading or publishing content on the Service, the user grants Piklabs the following limited licence:

• to host the content on the Service,
• to display the content to the relevant users,
• to technically reproduce and store the content,
• to back up the content,
• to classify the content within the scope of user preferences and service functions,
• to use the content for the purpose of promoting the Service, in a manner consistent with the nature of the content and with the user's visibility preference.

This licence is:

• worldwide,
• royalty-free,
• non-exclusive,
• limited to the operation of the Service,
• technically exercisable through sub-service providers

in nature.

The licence granted to Piklabs in respect of user content does not mean that ownership of the content passes to Piklabs. Piklabs may not use user content as a standalone commercial product for purposes other than operating and promoting the Service.

The user undertakes that it has the authority to upload the content it shares and to permit the use of such content. The user may not unlawfully share content containing the copyright, personal rights, private life or personal data of third parties.

When user content is deleted, Piklabs shall commence the process of removing that content from active systems. Complete deletion from technical backups or security logs may take a reasonable period depending on the backup cycle. Retention obligations are reserved in respect of records that must be kept under legislation, ongoing disputes and security logs.

9. Responsibility for user content

The user is responsible for the lawfulness of the content it uploads to or publishes on the Service.

In particular, the user accepts:

• that it has the authority to publish the content,
• that the content does not infringe the rights of third parties,
• that the content does not constitute a criminal offence,
• that the content does not contain personal data unlawfully,
• that the content does not endanger the safety of children,
• that the content is not misleading or deceptive

and confirms the foregoing.

Piklabs may temporarily make content invisible, review it or remove it on the basis of an application by a third party, a request from an official authority, a court decision, reasonable suspicion of a breach or community safety grounds.

10. Reports, content review and moderation

Users may report threads, comments, profiles or other user content through the relevant menu or support channels.

Reports;

• the content reported,
• the reason for the report,
• the explanation given,
• the date of the report,
• account and content information

are assessed on the basis of the above.

Where a thread or comment is reported by three different users, the content may be technically and temporarily made invisible. This alone does not constitute a final decision that the rules have been breached. If, following review, the content complies with the rules, it may be republished.

Automatic word filtering may be applied in respect of profanity, insults, hate speech or other prohibited expressions. The fact that content is not published as a result of automatic filtering does not prevent the user from requesting a review at support@picue.app.

Unlike content reports, profile reports do not, as a rule, give rise to automatic sanctions; they are assessed by the moderation team.

Piklabs shall assess user content reported to it that is clearly unlawful or clearly contrary to the community rules within twenty-four hours of receipt of the notification and, where it deems necessary, shall remove the content, limit its visibility or apply a measure in respect of the relevant account. In cases of serious violations such as child sexual abuse, serious threats and terrorist propaganda, the assessment and the measure shall be carried out immediately.

Piklabs may remove content that clearly appears to breach the rules, or apply temporary restrictions to accounts, without waiting for a report. The fact that Piklabs carries out a preliminary review of content does not mean that it continuously monitors every item of content published on the platform or that it guarantees the prior detection of all breaches.

Reports that are unfounded, made in bad faith or intended to bring about the unlawful removal of another user's content may also constitute a breach of these Terms of Use.

11. Moderation decisions and sanctions

In the event of a breach of these Terms of Use, Piklabs may apply one or more of the following measures, depending on the nature and gravity of the breach:

• removing the content,
• limiting the visibility of the content,
• placing the content under temporary review,
• issuing a warning to the user,
• temporarily restricting certain features,
• temporarily suspending the account,
• permanently closing the account,
• restricting accounts or technical access connected with the breach,
• notifying the competent authorities where legally required.

In applying sanctions, the gravity of the breach, whether it is repeated, the harm caused to the user or to third parties, intent or negligence, the manner in which the content has spread and platform security shall be taken into account.

As a rule, breaches occurring within the last 90 days shall be taken into account in the assessment of sanctions. The aim is that records of breaches older than 90 days are not taken into account in calculating sanctions; however, records may be retained in respect of ongoing security incidents, legal disputes, serious breaches, account security or retention obligations arising from legislation.

The graduated sanction system may be applied as follows:

• first breach: warning,
• second breach: suspension for 7 days,
• third breach: suspension for 30 days,
• fourth breach: permanent account closure.

This order is not an invariable sequence that must necessarily be followed in every case. In cases of harassment, hate speech, child abuse, seriously unlawful content, impersonation, serious threats, persistent spam, fraud or serious attacks on platform security, permanent account closure or another severe measure may be applied directly.

During a suspension, the user may be permitted to read content or to access limited parts of the Service; however, features such as creating new threads or comments may be restricted.

12. Permanent account closure and blacklisting

A user whose account has been permanently closed may not open a new account and may not use another account, device, e-mail address or technical method in order to circumvent the closure.

Piklabs may process technical data that is necessary and proportionate in order to prevent an account from being reopened. Where it is intended to keep an e-mail address on a blacklist, only the data necessary for that purpose shall be retained; access rights shall be restricted and a retention period shall be determined.

Blacklisting is not carried out indefinitely or without limit. Piklabs shall assess at regular intervals whether it remains necessary to retain blacklist data.

The user may submit an objection to a decision on account closure or blacklisting to support@picue.app. Upon objection, the decision shall, where deemed appropriate, be reviewed again by a member of the moderation team.

13. Blocking feature

The user may block any other user by using the blocking feature within the application.

Depending on the technical operation of the application, the blocking feature;

• that the content of the blocked person is not displayed,
• that notifications are limited,
• that mutual interaction is restricted,
• that the blocked person cannot see the user's content

may provide each of the above.

Blocked users may be managed under Settings → Blocked users. The blocking feature does not prevent Piklabs from taking separate action in respect of serious breaches, security or legal obligations.

14. Objections to moderation decisions

The user may object, via support@picue.app, to a decision on content removal, account suspension, feature restriction or account closure taken in respect of them.

In order for an objection to be assessed;

• the decision objected to,
• the username or account information,
• the grounds for the objection,
• any explanatory information and documents

must be submitted.

Objections shall be assessed within a reasonable period and by a review method appropriate to the nature of the decision. The aim is for the objection to be reviewed by a member of the moderation team; however, Piklabs does not guarantee any particular outcome or change in respect of all decisions.

The objection process does not automatically suspend the enforcement of measures applied immediately on account of manifestly unlawful content, child abuse, a serious security threat or a request from a competent authority.

15. piCue Plus subscription

Certain features may be offered under a piCue Plus subscription. The subscription may be offered in monthly or annual periods, or for another period specified on the purchase screen.

The following information is clearly displayed on the subscription purchase screen:

• the type of subscription,
• the subscription period,
• the price,
• any taxes and additional charges,
• any free trial period,
• the start date of the paid period,
• the automatic renewal condition,
• the method of cancellation,
• the rules applicable to refunds and withdrawal,
• the application store through which the subscription is purchased.

Where a 1-week free trial is offered to users subscribing for the first time, the trial period and the conditions under which the trial will convert into a paid subscription are also shown on the purchase screen. The free trial may be applied once per store account by the Apple App Store or Google Play.

If the user does not cancel the subscription before the end of the trial period, the subscription may move to the paid period in accordance with the conditions clearly notified on the purchase screen. Before the transition to the paid period, the user shall be provided with the necessary information regarding the payment method to be used, the price and the renewal conditions.

Unless cancelled by the user, the subscription may renew automatically at the end of the period specified on the purchase screen. In order to prevent automatic renewal, the user must cancel through the subscription settings of the relevant application store and within the periods specified by that store.

For subscriptions purchased through the Apple App Store or Google Play, part of the payment, subscription verification, automatic renewal, cancellation, collection and refund processes may be subject to the rules of the relevant store. This does not, however, remove Piklabs's obligations towards the consumer arising from mandatory legislation.

As a rule, cancellation of the subscription takes effect at the end of the current paid period. Cancellation does not result in an automatic refund in respect of the unused part of the purchased period; however, rights arising from law, from the rules of the application store, from defective service or from Piklabs's specific refund policy are reserved.

In the event of a change to the price or to the subscription terms, the user shall be notified clearly and comprehensibly before the change takes effect. Material changes to the detriment of the consumer may not be applied to the user's current subscription period in a manner contrary to mandatory legislation.

16. Withdrawal, termination and refunds in subscriptions

The consumer's rights of withdrawal, termination, defective service, refund and other statutory rights are reserved in respect of subscription transactions.

Where performance of the digital service is commenced within the withdrawal period at the consumer's express request and the consumer has been informed in accordance with the legislation of the loss of the right of withdrawal, there may be cases in which the right of withdrawal cannot be exercised. This assessment shall be made taking into account the information provided on the purchase screen, the manner in which performance of the service commenced and the applicable legislation.

Where a right of withdrawal exists, Piklabs shall enable the user to submit a withdrawal notice to hey@picue.app or through the relevant channels of the application store where the purchase was made.

The body to which the user should apply may vary depending on whether the subscription was collected by Piklabs, by the Apple App Store or by Google Play, and on which body is shown as the provider in the transaction. Clear information on this matter is given to the user on the purchase screen.

17. Price changes

Subscription prices, campaigns and free trial conditions are shown on the purchase screen.

Price changes may be made for future subscription periods due to changes in taxes, exchange rates, application store policies, service costs or commercial conditions.

A price change may be applied to the current subscription period without prejudice to the mandatory provisions of consumer legislation. The user shall be given reasonable and clear notice before the price change takes effect.

If the user does not accept the price change, the user may stop the renewal. The cancellation method is shown in the subscription settings of the application store where the purchase was made.

18. Intellectual and industrial property rights

The rights in the piCue name, logo, brand elements, Picsona characters, interface design, software code, database structure, visual design, texts and other elements of the Service belong to Piklabs or to the relevant rights holders.

Without the written permission of Piklabs or of the relevant rights holder, these elements;

• may not be copied,
• may not be reproduced,
• may not be distributed,
• may not be published,
• may not be sold,
• may not be rented out,
• may not be subjected to reverse engineering,
• may not be modified to create derivative products,
• may not be used for commercial purposes.

By using the Service, the user does not acquire any ownership or licence right in Piklabs's trade marks, software, designs, databases or other intellectual and industrial property rights. The user is granted only a limited, personal, non-transferable and revocable licence to use the Service in accordance with these terms.

19. Third-party content and TMDB

Film and series credit information, posters, images, ratings and similar content may be obtained from third-party providers.

Where TMDB is used, it is acknowledged that piCue is not endorsed or certified by TMDB and that the rights in the content and images belong to the relevant rights holders.

In respect of third-party content;

• the currency of the content,
• its completeness,
• its accuracy,
• its suitability for a particular age group or in terms of personal sensitivities,
• the availability of the relevant content on another platform

is not guaranteed by Piklabs.

If you believe that an item of content infringes copyright, trade mark rights, personal rights or any other right, you may submit a notification to hey@picue.app. In the notification;

• the content alleged to be infringing,
• the link to or location of the content,
• the right infringed,
• the contact details of the applicant,
• any documents evidencing the right

must be stated.

Piklabs may review the notification and temporarily remove the content, limit its visibility or, where it considers the notification justified, remove it permanently.

20. Availability of the Service and changes

Piklabs may add new features, change existing features or withdraw them in order to improve the Service.

The Service or a part of it may be temporarily unavailable due to technical maintenance, security updates, a change of service provider, force majeure, application store operations or information security grounds.

Piklabs does not guarantee that the Service will at all times be uninterrupted, error-free, secure or operate in the same way on all devices. However, the provisions on defective service, refunds, termination and other mandatory rights are reserved in respect of consumer transactions.

Where the removal of a feature of the Service materially affects the essential performance of an active paid subscription, the consumer rights of the user in respect of the current subscription period shall be separately assessed.

21. Nature of recommendations and user responsibility

The recommendations and matches provided on piCue are intended for entertainment, discovery and information purposes.

Recommendations;

• the user's preferences,
• the user's interactions within the application,
• content databases,
• technical classifications,
• the personalisation systems used

may be generated on the basis of the above.

The age rating of a production, its content warnings, information on violence or sexual content, its suitability in terms of personal sensitivities and its availability must be separately checked with the relevant streaming platform.

Piklabs does not guarantee that the recommendations will meet the expectations of every user or that a particular item of content will be suitable for a particular user.

22. Scope of liability

Piklabs is liable for damages arising from its own fault for which it must be held liable under applicable law.

In no way do these Terms of Use;

• the statutory rights of the consumer,
• liability arising in cases of gross fault or intent,
• liability arising in cases of personal injury or death,
• mandatory rights arising from defective service,
• liability arising from the unlawful processing of personal data,
• other liabilities that cannot be limited by law

exclude or limit any of the above.

To the extent permitted by applicable law, Piklabs may not be held liable for damages arising from the user's own device, internet connection, third-party platforms, content shared by the user, incorrect account information or the user's use of the Service contrary to these terms.

Without prejudice to mandatory provisions of law, Piklabs's liability shall be assessed as being limited to direct and foreseeable damages. Where consumer legislation and other mandatory provisions provide for broader liability, those provisions shall apply.

23. Updating of the Terms of Use

Piklabs may update these Terms of Use due to changes in the service, in the technical infrastructure, in legal regulations or in commercial conditions.

A new last update date and version number shall be added at the beginning of the updated text.

In respect of changes that materially affect the user's rights, the subscription terms, the fees, account sanctions, the content licence or the liability provisions, the user shall be informed by in-app notification, e-mail or another appropriate means of communication.

Material changes to the detriment of the consumer may not be applied retroactively to the consumer's current contract or subscription period in a manner contrary to mandatory legislation.

If the user does not accept the updated terms, the user may close their account and may choose not to renew their paid subscription. However, closing the account does not extinguish accrued rights and obligations relating to payment, refunds, compensation, intellectual property, confidentiality or disputes.

24. Deletion and suspension of the account and termination

The user may delete their account at any time through the Settings → Delete my account option within the application. Account deletion cannot be undone.

Deletion of the account;

• the user profile,
• photographs,
• lists,
• collections,
• threads,
• comments,
• follow relationships,
• user preference information

shall result in the deletion of the above, or in their being rendered incapable of being associated with an identity, unless there is a legal ground requiring their retention.

In the event of a breach of these Terms of Use, Piklabs may temporarily suspend or permanently close the account.

Except in cases of serious and manifest breaches, the user shall, as far as possible, be informed of the decision and of its principal grounds. Cases in which such notification would be inadvisable in terms of security, legal review, a request from a competent authority or the prevention of abuse are reserved.

Termination of the account does not extinguish the provisions relating to payment, refunds, compensation, confidentiality, intellectual property, content or disputes that arose before the account was closed.

25. Personal data and privacy

Personal data may be processed within the scope of the user account, usage activities, content, technical records, subscription and moderation processes.

Details regarding the processing of personal data;

• in the Piklabs Privacy Notice on the Processing of Personal Data under the KVKK,
• in the piCue Privacy Policy,
• where necessary, in the separately provided explicit consent and cookie texts

are explained in the above.

Accepting the Terms of Use does not mean that you have separately given explicit consent in respect of the processing of personal data. Separate consent shall be obtained for advertising, marketing, promotional or other processing that requires explicit consent.

The sharing of user content and its publication in publicly accessible areas means that the content may be seen by other users. The user must assess for themselves the private life and personal data risks relating to content they share in a publicly accessible area.

In order for applications to be assessed, the applicant may be asked for additional information suitable for verifying their identity and determining the scope of the request.

27. Governing law and resolution of disputes

These Terms of Use are governed by the laws of the Republic of Türkiye, without prejudice to mandatory provisions of law.

In consumer transactions, the consumer's rights arising from Law No. 6502 on Consumer Protection and the related legislation;

• to apply to the consumer arbitration committee,
• to bring an action before the consumer court,
• to apply to the competent authorities at their place of residence,
• to exercise the rights of withdrawal, termination, refund and defective service

are reserved.

In disputes that may arise with users who are not consumers or with persons acting for commercial purposes, the legally competent courts and enforcement offices of İstanbul shall have jurisdiction. This provision does not set aside the rules of jurisdiction laid down by law for consumers.

Before a dispute arises, the user may contact Piklabs at support@picue.app or hey@picue.app. Such an application does not of itself suspend or extend the periods for bringing an action, a complaint or an application to which the consumer is legally entitled.

28. Severability and non-waiver of rights

If any provision of these Terms of Use is found by a competent authority to be invalid, unenforceable or contrary to mandatory law, the remaining provisions shall remain in force.

The invalid provision shall be construed, on a limited basis, in accordance with the provision closest to the economic and legal purpose of the parties and consistent with applicable law. However, this provision may not be interpreted so as to create a new obligation to the detriment of the consumer.

Piklabs's failure to exercise, or delay in exercising, any of its rights in a particular case does not mean that it has entirely waived that right.

29. Additional terms relating to the licence obtained through the Apple App Store

This section applies where the piCue application is downloaded or used through the Apple App Store and contains the minimum provisions required by the developer agreement between Apple Inc. and Piklabs. In the event of any conflict concerning Apple between this section and the other provisions of these Terms of Use, this section shall prevail as regards Apple.

Parties to the agreement: These Terms of Use are entered into solely between the user and Piklabs; Apple is not a party to this agreement. Piklabs, and not Apple, is solely responsible for the application and its content.

Scope of the licence: The user is granted a non-transferable licence to use the application on any Apple-branded products that the user owns or controls, in accordance with the Usage Rules set forth in the App Store Terms of Service published by Apple. In respect of other accounts that gain access through Family Sharing or volume purchasing, the application is subject to the relevant Apple rules.

Maintenance and support: Piklabs is solely responsible for providing maintenance and support services in respect of the application. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the application.

Warranty: Piklabs is solely responsible for any product warranties in respect of the application. In the event of any failure of the application to conform to any applicable warranty, the user may notify Apple, and Apple may refund the purchase price, if any, to the user. To the maximum extent permitted by applicable law, Apple shall have no other warranty obligation whatsoever with respect to the application other than the refund of the purchase price. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty shall be the sole responsibility of Piklabs.

Product claims: The user's claims relating to the application, including claims relating to the ownership or use of the application, product liability, compliance with legal or regulatory requirements and consumer protection legislation, shall be directed to Piklabs and not to Apple. Piklabs is solely responsible for addressing such claims.

Intellectual property claims: Piklabs is solely responsible for the investigation, defence, settlement and discharge of any claim that the application or the user's use of the application infringes the intellectual property rights of a third party.

Legal compliance representation: The user represents that they are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a terrorist supporting country, and that they are not listed on any U.S. Government list of prohibited or restricted parties.

Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms of Use. Upon the user's acceptance of these terms, Apple shall have the right to enforce these terms against the user directly as a third-party beneficiary.

30. Entry into force and acceptance

These Terms of Use enter into force on 14 August 2026.

The user should review this text before creating an account or using the Service. The user's ticking of the “I accept” option, creation of an account or continued use of the Service means that the user accepts these Terms of Use.

If the user does not accept the terms, the user must not use the Service.
